The present terms of sales aim to lay down rules that govern every agreement between Optique Concept Diffusion (OCD) and his customer.
Every order passed on Sunclip-on website implies their prior acceptation.
If they would come to be modified, terms of sales in force at the order's day would be apply.
1. ORDER
Every order validated by the customer is an irrevocable acceptance of the terms of sales.
This validation is the same as a handwritten signature.
For every order, the customer will receive by e-mail :
The name of the item(s) ordered.
The quantity
The total
The way of payment chosen
OCD reserve the right to verify or ask, if needed, additional documents, particularly in case of professional order.
If the asked documents are not supplied or if they contain false informations, OCD will be able to cancel the order.
Orders paid by check will be processed on receiving payment. The customer has 7 working days to send his payment, time beyond which no guaranty will be given as for items availability.
During this period, items will be put aside.
Shipping time doesn't include time for payment receipt.
We advise us to keep all the data relating to the order and to carefully verify that all the informations you gave to OCD are right and complete to permit processing your order.
We shouldn't be taken for responsible in case of wrong capture of the customer for the delivery mistakes or lateness it could bring about.
In that case, all of the returns fees will be chargeable at the customer.
2. PRODUCTS
OCD commit itself to giving a maximum of informations in order to allow the customer to place an order in an optimal way.
Offers on website are only available within the limit of stock and can be modified or stopped without notice according to our supplier constraint.
Pictures, texts, graphics illustrating our products are not contractual, consequently OCD shouldn't be committed for mistakes or omission in one the picture or text.
OCD shouldn't be committed for an order non-fullfilment if the item is out of stock or in case of major force, strikes, flooding, fire or riots.
Consequently no responsibility can be engaged in case of eventually business loss or damage.
3. PRICES
Prices are shown in euros including VAT and are applicable at the validation date of the order.
They don't include shipping costs.
The order has to be paid in once time, unless a specific offer appear on the website.
4. PAYMENT
The customer can pay his order by two means :
Online payment (PayPal or credit cards through PayPal) or checks.
Every payment by check will be done with one providing from a French metropolitan bank.
Delivery time of the orders paid by checks must be understood by the date of the payment receipt.
OCD reserve the right to cancel the order in case of :
nonpayment within 7 days for check payment.
Refusal from PayPal authorization for payment.
Current contention with the customer.
OCD have been discharge from the responsibility of fraudulent use of some payment mean, in spite of the systematically made verifications.
OCD keep the entire property of his products until they are paid, including shipping fees.
IP Address of the customer is saved for every order. In case of fraud, OCD will permit to the bank and other authorities to access to all informations they could need.
5. AVAILABILITY
OCD does its best to deliver your order within 2 and 10 working days after order validation.
However, if it wouldn't occur, order will be processed in the latest 30 days following the order validation and payment.
In case of unavailability of the ordered items, the customer will be informed as soon as possible and will be able to cancel his order.
He will be allowed to ask for replacement or repayment.
In case of impossibility to replace the product, OCD will cancel the order and proceed to repayment within 30 days.
Product availability is given for information only.
6. SHIPPING
OCD ships parcels by French mail with Coliposte Expert.
Parcels are delivered by signature in 4 to 8 days and covered by insurance depending on order value.
Orders are shipped to the address given by the customer inside european union only.
OCD can't be taken for responsible in case of lateness or shipping problem due to a mistake of the customer when entering his details, as for disruption of the mail.
We advice the customer to verify the parcel at the moment of the delivery. If a problem is detected, please indicate damages on the delivery sheet as well as to OCD within 2 working days.
No complaint would be accepted if no reserves have been made on the delivery sheet.
An e-mail containing the tracking number of his parcel is sent to the customer as soon as his order is shipped.
The tracking can be made on the French mail website.
If no parcel is received within 8 days, please contact us.
In the last 21 days, if no parcel has been found, we'll wether replace or refund the order.
7. DELIVERY MISTAKES, NON MATCHING PRODUCTS
In case of mistake or non-matching product with these on the order form, customer will contact OCD at the latest 1 following working day. No complaint will be received beyond this limit.

A number will be then be attributed which will have to come with the returned order.
Items will be complete and correctly packed to be sent to the following address :

No return will be accepted without this number and the returning order will be shipped within 8 days.
8. RETRACTION RIGHT
The customer has 7 days from delivery date to return the products, at his own expense.
Every return must be previously indicated by e-mail at accueilsunclip-on.com with prefixing your mail object by [SunclipOn]
We recommend our customer to ship the parcel with an insurance in case of lost or damage.
Return fees are at customer expense.
The customer is allowed to ask for repayment or replacement of the products (shipping will still be to his own expense)
In case of use of the retraction right, OCD will proceed to repayment within 15 jours.
9. MAJOR FORCE
Neither OCD, nor the customer could be considered having failed to his obligations if they have been prevented or made late to.
Is considered as a case of major force every external, unforeseeable, unavoidable and outside our control fact.
The affected party will inform the other to agree or not upon the proceeding of the contract.
10. APPLICABLE LAW
Present terms of sale are submitted to French law and only the Versailles commercial court will be competent if the parties can't find an arrangement.
11. PRIVACY POLICY
In accordance with the French law “Informatique et libertés” n°78-17 du 6 janvier 1978, you can access the informations concerning yourself.
